Udlændingenævnet har i sagen fundet, at SIRI ikke havde opfyldt sin vejledningspligt, idet SIRI ikke individuelt og personligt havde vejledt vores klient om ansøgningsperioden, da han i december 2020 forinden ved fysisk fremmøde ved SIRI fik udstedt et opholdsdokument. På baggrund heraf har Udlændingenævnet tilbagesendt sagen til SIRI med henblik på, at SIRI skal tage stilling til, om vores klient kan få udstedt et opholdsdokument efter Brexit-bekendtgørelsen.
